Chapter I General Provisions

Article 1 (Purpose)

The purpose of this agreement is to establish basic matters concerning the conditions and procedures of information provided by Neovalue Co., Ltd.

Article 2 (Effect and change of terms and conditions)

  1. These Terms and Conditions shall become effective by posting and disclosing to the Information and Neo Value Co., Ltd.
  2. Neo Value Co., Ltd. may change these terms and conditions in the event of a reasonable reason, and if the terms and conditions are changed, they shall be disclosed without delay.
  3. Members who use the membership service may suspend the use of information and terminate the use if they do not agree to the changed terms and conditions.
    Continuous use of information after the effective date of the terms and conditions shall be deemed to have agreed to the changes to the terms and conditions.

Article 3 (Application of Terms)

  1. These terms and conditions apply together with the information on the use of individual information provided by Neo Value Co., Ltd.
  2. Matters not specified in these terms and conditions can be applied to the relevant laws and information guidance.

Article 4 (Organization of Terms)

  1. The terms used in these Terms and Conditions are defined as follows:
    ① The term “user member” means a member who uses membership information.
    ② The term “use contract” refers to a contract concluded between Neo Value Co., Ltd. and the user member in relation to the use of information.
    ③ User number (ID) refers to the combination of letters and numbers selected by the user member and given by Neo Value Co., Ltd. for the identification of the user member and the use of the information of the user member.
    ④ The term “password” means a combination of letters and numbers selected by a user member to confirm that the user member is a user member consistent with the user number granted and to protect the rights and interests of the customer.
    ⑤ Terminal refers to personal computers and modems installed by customers to use the information provided by the company.
  2. The definition of terms used in these Terms and Conditions shall be governed by the relevant laws and information guidelines, except as provided in paragraph (1).

Chapter II Effect of Terms and Conditions

Article 5 (Separation of Information)

The types and contents of information are separately determined by the information guidance of Neo Value Co., Ltd.

Article 6 (Establishment and Conclusion Unit of Use Contract)

The use contract is established with the approval of use of Neo Value Co., Ltd. for the application of the use member.

Article 7 (Application for Use and Consent to Terms and Conditions)

Neo Value Co., Ltd. provides most of the information to users who have agreed to the information terms and conditions of Neo Value Co., Ltd. It is deemed that the user has agreed to this information usage agreement by pressing the consent button through the registration process.

Chapter III Obligations of Users

Article 8 (Pending and suspending the use of information)

  1. Neo Value Co., Ltd. may not accept applications for the use of information falling under any of the following subparagraphs.
    ① In the case of applying in the name of another person
    ② Where it is found that the contents entered in the membership registration information are false;
    ③Where it is difficult to accept the use due to other reasons attributable to the member applying for use;
  2. If an application for information use falls under any of the following subparagraphs, Neo Value Co., Ltd. may not accept the application until the reason for the restriction on acceptance of the application is resolved.
    ① Where there is no room for facilities of Neo Value Co., Ltd
    ② In case of technical difficulties of Neo Value Co., Ltd
    ③ Where it is difficult to accept the use due to other reasons attributable to Neo Value Co., Ltd
  3. Neo Value Co., Ltd. shall immediately notify the application member if the application for use is rejected or the consent is restricted according to the provisions of paragraph (2).

Article 9 (Assignment and Change of User ID)

  1. Neo Value Co., Ltd. grants user IDs to members who use the membership service as prescribed in the terms and conditions for each use of information.
  2. The user ID may be changed at the request of the user member or Neo Value Co., Ltd. in the following cases:
    ① Where the user ID is registered with the user’s phone number or resident registration number, etc. and there is a risk of invasion of privacy;
    ② In the case of disgusting others or violating the customs and manners;
    ③ Where there are other reasonable reasons
  3. The customer shall not have the user ID used by a third party and shall pay attention to the management of the user ID and password.
  4. Other matters concerning the management and change of user IDs shall be governed by the information usage guidelines.

Chapter IV Suspension and Termination of Use of Information

Article 10 (Natural Disaster)

  1. Neo Value Co., Ltd. may restrict or suspend all or part of its services in the event of war, disaster, natural disaster, or equivalent national emergency, or for other unavoidable reasons, such as the suspension of telecommunications services by a key carrier under the Telecommunications Business Act.
  2. When Neo Value Co., Ltd. restricts or suspends the use of information under the provisions of paragraph (1), it shall notify the user of the reason and the period of limitation without delay.

Article 11 (Suspension of Information Use)

  1. Neo Value Co., Ltd. may delete the post, restrict or suspend the use of all or part of the information use if the information use of the member falls under any of the following subparagraphs:
    ① ① Where a user fails to fulfill his/her obligations;
    ② In the case of obstructing the stable operation of information use;
    ③ Where obscene, vulgar, threatening content, advertising information, e-mail, etc. are continuously transmitted against the intention of the recipient;
    ④ Where a computer virus program, etc. that causes malfunction of information and communication facilities or destruction of information, etc. is distributed;
    ⑤ In the case of posting, e-mailing, or otherwise transmitting information that infringes on the intellectual property rights of another person;
    ⑥ Where a request for correction by the Information and Communication Ethics Committee is made or an interpretation of the authority of the Election Commission in connection with illegal election campaigns is obtained;
    ⑦ If you use someone else’s ID and password (PASSWORD)
    ⑧ Where information obtained by using information is reproduced or distributed or commercially used without the prior consent of Neo Value Co., Ltd.;
    ⑨ Where it violates laws, etc. related to telecommunications;
    ⑩ To collect or store other people’s personal information
    ⑪ Other forms of solicitation, such as advertising, promotional materials, junk mail, spam, and lucky letters, are posted, e-mailed, or otherwise transmitted without the approval of NeoValue Inc.
    ⑫ Violating the rights of a third party or slandering others;
  2. Where the use of members is restricted according to the provisions of paragraph (2), specific standards, such as the type and period of deletion or restriction of posts, shall be separately determined in the information use guide.

Article 12 (Restriction and cancellation of the use of information)

  1. If Neo Value Co., Ltd. intends to restrict the use of information according to the provisions of Article 11, it shall notify the user of the reason, date, etc. However, this is not the case if Neo Value Co., Ltd. recognizes that it is necessary to stop using it urgently.
  2. A member who has been notified of the suspension of use according to paragraph (1) may file an objection to the notice of the suspension of use.
  3. Neo Value Co., Ltd. may temporarily postpone the suspension of use until the period for confirmation of the objection according to the provisions of paragraph (2), and notify the user of the result.
  4. If it is confirmed that the reason for suspension of use has been resolved during the suspension period, Neo Value Co., Ltd. shall immediately lift the suspension measure.

Article 13 (Change of registration information for membership information)

If a user intends to change the registration information of a member, such as an address, he/she may change it by using an application for change of the use contract, using information, or by phone, as prescribed by the information use guide.

Article 14 (End of Use)

  1. Neo Value Co., Ltd. may prevent users from using information such as ID deletion if they use information in violation of the following criteria.
    ① Upload commercial software or crack files
    ② Where pornography is posted in violation of Article 7 of the Detailed Rules for Deliberation by the Information and Communication Ethics Committee;
    ③ Where the content is included to perform anti-national acts;
    ④ Where he/she violates Article 11 except in the case of unauthorized reproduction of copyrighted articles or posting MP3;
  2. The criteria for termination of use of information not specified in this agreement shall be determined by relevant laws and regulations and information usage guidelines.

Article 15 (Protection of user’s personal information)

Neo Value Co., Ltd. shall endeavor to protect the user’s personal information, including the user’s registration information, as prescribed by the relevant laws and regulations. The personal information protection of users shall be governed by the relevant laws and regulations and the “Neo Value Co., Ltd. Personal Information Protection Policy” prescribed by Neo Value Co., Ltd.

Chapter V Compensation for Damages

Article 16 (Disclaimer)

  1. Neo Value Co., Ltd. is exempt from liability for damages arising from the selection or use of information data or failure of the member to obtain expected profits from the provision of information by Neo Value Co., Ltd.
  2. Neo Value Co., Ltd. is exempted from liability in the event of a failure to use information due to reasons attributable to the user member.
  3. Neo Value Co., Ltd. is exempt from liability for the contents of the data posted or transmitted by the user.
  4. Neo Value Co., Ltd. is exempted from liability in case of goods transactions between users or between users and third parties through information use.
  5. Neo Value Co., Ltd. is not responsible for storing and transmitting data for all information use and is exempted from liability even if there is a loss of data.
  6. Details not prescribed in this section are exempted from Neo Value Co., Ltd. following the usage rules for each information use.

Chapter VI Dispute Mediation

  1. Except as otherwise provided for in these Terms of Use, disputes concerning the use of services shall be resolved by bilateral agreement as much as possible.
  2. If a lawsuit is filed against a dispute arising from the use of the service, the court having jurisdiction over the location of the company shall be the competent court.

– Supplementary Provisions (Effective Date) –

These terms and conditions will take effect from 03/01/2013
